Navigating the complex world of the court system can be tough ? especially for a regular person without experience or for somebody up against powerful interests. People often find themselves confused and trampled upon by forces seemingly beyond their control. When there is corruption involved, it can be even harder. But according to experts with the Foundation for the Child Victims of the Family Courts (FCVFC), there is somebody who may be able to help: a forensic advocate.
Forensic advocacy is an emerging field that has developed to protect clients from a range of problems frequently encountered in the American court system ? biases, prejudices, attorneys with divided loyalties, corruption, and more. It brings together diverse specialties like psychoanalysis, forensic analysis, mediation services, psychological reviews, conflict management, and litigation strategies.
The end goal, of course, is to reach optimal resolutions for all of the parties involved. But the welfare of any children who may be caught in the crossfire is the highest priority ? particularly in cases involving abuse, neglect, and other serious problems placing them in jeopardy.
In some cases, forensic advocacy even extends into the public domain. Efforts to publicize problems and pressure key players into accountability, for example, can include shedding light on the inner workings of the system to the scrutiny of publicity. Other situations may require filing formal complaints with various administrative bodies such as medical boards or state bar associations. Authorities sometimes need to be involved as well.
Oftentimes, clients will need help from other experts, too. So a good forensic advocate works with broad networks of specialists ?legal, medical, and more – to provide necessary support and protect the rights of clients as required. As with any field, teamwork is often crucial to success.
?The client is only there for a moment in time, whereas the court personnel are really permanent fixtures, so the clients and their needs become like disposable commodities,? said forensic advocate Jones-Soderman, executive director of the Foundation for the Child Victims of the Family Courts and a pioneer in the field of forensic advocacy. ?We deal with a lot of people that nobody else wants to.?
People who could benefit from forensic advocacy services include, for example, clients involved in high-conflict divorces or problematic child custody issues. Another area where forensic advocacy might be able to help is in dealing with the increasing use of toxic psychiatric diagnoses to target vulnerable individuals in court proceedings. Even criminal and civil cases can often derive value from the services.
?We work with anybody who is having difficulties articulating their position,? Jones-Soderman explained in an exclusive interview with this reporter. ?The forensic advocate is there to help the client understand what the argument is and to support them every step of the way as they make their case in court.?
Successful professionals in the field of forensic advocacy are generally present at trials and are expected to become intimately familiar with all aspects of a case. Personal interviews with everyone involved and a thorough review of all relevant documents are both necessary as well – mostly to gain a full understanding of the situation and come up with a workable strategy to win. Client confidentiality, of course, is always respected.
?Our role is to go through every legal document, to interview everyone involved, to be present in court, and to help the client navigate their way through the complex process successfully,? said Jones-Soderman, a psychoanalyst by training with many years of education and hands-on experience taking on powerful interests in the service of her clients.
Obviously, a resolution that makes everyone happy is the best outcome. ?We always try to find a peaceful agreement first,? Jones-Soderman explained, adding that it was unfortunately not always possible to reach a pleasant ending to a case. ?There are, however, situations rife with complex issues that are not as amenable to simple solutions ? cases where, for example, there is evidence of severe psychopathology that goes unrecognized by the court.?
Forensic analysts and advocates ? good ones, at least ? go where others are afraid to tread. They deal with issues of professional malpractice, abuse of power, problems with state agencies including CPS and other coercive bodies, and more. Tackling ignorance and indifference are also all part of a day?s work in the world of an advocate worth his or her pay.
?What we find in these high-conflict divorce cases where there is a great deal of acrimony is that there is often a drive to silence a person who has a legitimate claim ? people who have hard data and factual evidence to support their claim,? said Jones-Soderman, who has been in private practice for almost four decades as a family therapist, mediator and forensic consultant with a long record of satisfied clients. ?In family courts in particular we see this driven at the discretion of the judge, and it is therefore oftentimes highly biased.?
Jones-Soderman is the founder and chief of the Foundation for the Child Victims of the Family Courts (FCVFC), a non-profit organization dedicated to obtaining justice for families and children facing tough circumstances. The Foundation has a truly distinguished and active board of international professionals composed of attorneys, a pediatric physician, teachers, children advocates, parenting coordinators, therapists, and writers.

California Divorce Court How to Get Divorced Without Going There

Going to California divorce court and letting a judge make all the decisions is not the best way to get divorced. If you and your spouse can work together to agree on the legal issues of your case-how youll handle division of your property and debts, support, and parenting if you have minor childrentheres a much better option.
The two of you can create a written agreement, called a Settlement Agreement; formerly called a Marital Settlement Agreement (MSA) before the Domestic Partnership legislation was enacted.
Even if cooperating with your soon-to-be ex is the last thing you want to do, the advantages of working out a Settlement Agreement are so huge that you should struggle long and hard to get one.
Look what you will gain:
You can be certain exactly what your divorce Judgment will be, instead of letting a judge who doesnt know you or your situation make the decisions for you.You can complete your case by mail and you wont have to go to California divorce court.When you both participate in creating your agreement, each person can feel confident about proceeding with the divorce without fighting in court because the terms of your divorce Judgment have already been settled by your Settlement Agreement.You wont need lawyers, and so will eliminate expensive legal fees.Youll have better relations with your ex-spouse after the divorce. This is especially important for better post-divorce parenting if you have kids.You are much more likely to get better cooperation with the terms of your divorce after the Judgment.The first thing many people do when theyve decided to get divorced is rush off to a law office and retain an attorney. This almost guarantees that your case will end up with a legal battle in California divorce court.Now that youve seen the advantages of working out a Settlement Agreement between yourselves instead of hiring attorneys, this doesnt need to happen to you.The goal of filling out California divorce forms and creating your Settlement Agreement is to get a Judgment that will settle the legal issues in your case and order your marriage dissolved.There are two ways you can get your Judgment:1. Filing a Declaration form with your final papers. This is the easiest method because you can file all the required forms by mail, or personally deliver them to the court Clerks office, without having to appear in court.
2. Going to a hearing in a California divorce court. Most counties in California dont want a hearing if your case is uncontested (youve been able to create a Settlement Agreement, which becomes your Judgment, or the spouse who is not the Petitioner did not file a response).
What To Do If You Have To Appear In CourtIf you are asked to appear at a hearing with an uncontested divorce, dont worry, its easier than you might think. Only the Petitioner has to go, and the hearing will be very brief. Most of your time in California divorce court will be spent waiting for your hearing to start. Family law judges see a lot of cases and will take no special interest in yours unless theres something unusual about it.
First you will have to set a date for your hearing with the Clerk at your countys California divorce court. At the hearing, when you are called, you take the stand and make statements about the facts of your case.
Your job at the hearing is to present evidence to the court that will allow the judge to make decisions. Be sure to bring with you any documents you have about the title or value of property or debts to be divided. If support is involved, bring recent pay stubs, accounting statements and tax returns to show the income of you and your spouse.
If you have a contested case, you will have no choice. You will have to appear in a California divorce court.

Question by i really don’t know….: divorce court?
hey, i’m just asking one thang.We have to go to court frist before we go to medition right?i’m just asking becuase when he filed for a divorce it gave a court date.but he’s saying that are child mite not be his but it is i’m thanking he’s just saying that becuase he’s wanting his new girlfriend to fill sorry for him lol…do they make you go to medition when you go to court or what i’m from oklahoma.or will they make you waite becuase he’s wanting a dna test done on are child.put i haven’t reseved any paper work telling where to go or when it’s going to happen.

First things first – I’m British so the rules won’t be the same, but whatever you do, MAKE SURE you keep ALL the paperwork you receive from courts, mediation services, solicitors – anything and anyone connected with your divorce. That said, I would have thought that a mediation service would have come first, but, as I say, I’m a Brit, so it might be different for you.

Legal Aspects: Jennifer D. Cisneros, Esquire, a partner with Whitbeck & Cisneros, P.C., is an experienced family law attorney who regularly practices in Northern Virginia. Her firm follows the philosophy that while it is always preferable to resolve family law matters outside the courtroom, attorneys must always be prepared to aggressively litigate family matters in court if a client's particular needs call for such services. Ms. Cisneros will give an overview of the legal aspects of divorce, including the separation and divorce process, equitable property distribution, and custody and support guidelines.
Financial Aspects: Pamela J. Sams, CRPC,is a Financial Advisor with Jackson Sams Financial Services in Northern Virginia. For 10 years, she has been helping women and their families improve their personal and financial wealth through good financial planning. Her education and training enables her to help clients successfully navigate through the myriad of personal and financial decisions they face during their lives. She assists them in attaining a higher level of financial security through education, understanding, and scenario planning. Pamela will talk about creating budgets for two households, valuing and dividing assets, the scenario approach to decisions, and retirement issues.
Emotional Aspects: Rona Hitlin-Mason, LPC,also holds Masters degrees in Counseling and Development and Accounting, and a Post-Master's Certificate in Marriage and Family Therapy. She strongly believes that you have the strength and skills to weather this transition in your life, and she finds it an honor to accompany people on their journey to self-acceptance and relief of symptoms. Rona will give you an emotional roadmap, talking about the emotional stages of divorce and how best to manage yourself during this journey. Her talk is entitled: Right Now It's Normal to feel "Crazy"!!
Real Estate Aspects: Pamela Jones, ABR, CRB, GRI,Pamela Jones, Inc., Long and Foster Realtors, is a career REALTOR® who began working with buyers and sellers in1983. Her dedication to her clients made her the #1 agent in Loudoun County in 2006. Pam has excellent business sense, detailed knowledge of the local market, and outstanding negotiating skills. Pam will give an update of the local real estate market, which differs vastly from the "national" picture we so often hear about.
Life Coaching Aspects: Ever Changing River, LLC,will lead you through some exercises to help you explore your core values and beliefs, and then create your "next steps" action plan. This action plan will be different for each person…from "let me continue to think about all this" to "here are my top 3 items to complete by next Friday." It is important to find the approach that is best for you, not someone else.
